Clear rules for a sensitive, personal service.
These draft terms govern access to the Beyond PMDD public website and private portal. Bracketed operator and commercial details must be completed and reviewed before launch.
1. Operator and agreement
These Terms are between the user and [LEGAL ENTITY OR INDIVIDUAL NAME], [ABN / ACN], of [REGISTERED OR BUSINESS ADDRESS]. By creating an account or using the private portal, the user agrees to these Terms and acknowledges the Privacy Policy.
Contact: [SUPPORT EMAIL].
2. Educational service, not medical care
Beyond PMDD provides educational information, personal reflection tools, prospective tracking, reports and permission-controlled sharing. It does not diagnose PMDD or any other condition, provide personalised medical advice, prescribe treatment or replace a qualified clinician.
Results, pattern labels and reports are based on user-entered information and may be incomplete or inaccurate. Clinical assessment, differential diagnosis, treatment and emergency decisions remain with qualified professionals and the user.
3. Not an emergency or monitoring service
Beyond PMDD does not continuously monitor entries, safety responses, messages or partner activity. No person should rely on the platform to identify or respond to immediate danger. In an emergency, contact local emergency services or a verified crisis service.
4. Eligibility
The minimum age and parent or guardian consent rule is [MINIMUM AGE / PARENTAL CONSENT RULE]. A user must have legal capacity to agree to these Terms or use the service through an approved consent arrangement.
5. Accounts and authentication
- Users must provide accurate account information and keep control of their email and Google account.
- An account must not be shared or used to access another person’s records without authority.
- Users must promptly report suspected unauthorised access.
- We may require re-authentication, suspend sessions or take protective action where security is at risk.
6. User content and responsibility for entries
Users retain ownership of information and content they submit. They give us a limited permission to host, process, reproduce and transform that content only as reasonably required to provide, secure and improve the requested service, comply with law and enforce these Terms.
Users are responsible for information they choose to enter, upload, export or share and should not upload another person’s confidential information without lawful authority.
7. Partner connections and sharing
A partner invitation does not transfer ownership of tracker data. The tracker user controls the connection and category permissions. A partner must use shared information respectfully, only for supportive purposes and must not attempt to bypass permissions, pressure the tracker user to disclose more, or treat a shared snapshot as medical advice.
Private partner check-ins are for the partner’s own reflection and are not automatically visible to the tracker user.
8. Acceptable use
- Do not attempt to access another account, bypass permissions, probe security controls or misuse invitation tokens.
- Do not upload malware, illegal content or material that infringes another person’s rights.
- Do not use the service to harass, threaten, exploit, impersonate or diagnose another person.
- Do not scrape, reverse engineer or overload the service except as permitted by law or written authorisation.
- Do not use urgent-support information as a substitute for emergency services.
9. Community features
If community publishing is enabled, additional community guidelines, moderation, reporting and consent rules will apply. Publication is not guaranteed. We may remove or restrict content to protect users, comply with law or enforce safety rules. Private messaging will not be available at initial launch unless a separate safety review is completed.
10. Third-party services
The service relies on providers such as Supabase, Vercel and optional Google authentication. Their services may be governed by separate terms and may be temporarily unavailable. External crisis, clinical and reference links are provided for convenience; Beyond PMDD does not control those services.
11. Intellectual property
Beyond PMDD and its licensors own the service software, design, branding, editorial content and documentation, excluding user content and third-party materials. A user receives a limited, revocable, non-transferable right to use the service for personal, lawful purposes while these Terms apply.
12. Availability, changes and beta features
We may improve, replace, suspend or discontinue features. Preview, staging and beta features may be incomplete and should not be relied on for clinical or emergency purposes. We will take reasonable care but do not promise uninterrupted or error-free operation.
13. Fees and subscriptions
Current public and staging features do not establish a paid subscription. Before any paid plan launches, pricing, billing, cancellation, refund and renewal terms will be added and presented before purchase.
14. Suspension and termination
A user may stop using the service and request account deletion. We may suspend or terminate access where reasonably necessary for security, unlawful activity, serious misuse, non-payment under a future paid plan or material breach of these Terms. Where practicable, we will provide notice and an opportunity to address the issue.
15. Disclaimers and liability
To the maximum extent permitted by law, Beyond PMDD is provided on an “as available” basis and we do not guarantee that user-entered information, generated summaries or educational content will be complete, current or suitable for a particular medical decision.
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. Any limitation of liability must be read subject to those non-excludable rights.
16. Governing law and disputes
These Terms are governed by the laws of [AUSTRALIAN STATE OR TERRITORY], Australia, subject to any mandatory law that applies where the user lives. Before commencing formal proceedings, the parties should attempt in good faith to resolve a dispute through written notice to [SUPPORT EMAIL].
17. Changes to these Terms
We may update these Terms. Material changes will be published and, where appropriate, notified before they take effect. Effective date: [EFFECTIVE DATE].
